Terms of Service

These terms apply when a business ("you", the "client") uses Ramflo. By creating or using an account you agree to them.

Using Ramflo

Ramflo is operated by Ramasubramanian AI Software Private Limited ("Ramflo", "we", "us"). It is a platform for sending consented WhatsApp and email messages to your own customers, running follow-ups, and managing replies in one inbox. Our team sets up your workflows, prompts and templates; you provide your business information, connect your accounts and operate your screens.

You must be able to enter a binding contract for your business, and the person who accepts these terms confirms they are authorised to do so. Our Privacy Policy explains how we handle personal data, and our role as your service provider for your contacts' data.

Acceptable use

You must not use Ramflo to:

• send spam or unsolicited messages, or message anyone who has opted out;
• send unlawful, misleading, abusive, harassing or fraudulent content, or content that infringes anyone's rights;
• collect or use data about people unlawfully, or send sensitive data you have no right to send;
• attempt to bypass limits, security or approvals, or to access another client's data;
• interfere with the service or use it in a way that puts our providers' services or reputation at risk.

Consent and compliance

• You are responsible for consent. You must have a lawful basis, and where needed the recipient's opt-in, to contact each person through each channel. Consent for email is not consent for WhatsApp marketing.
• You must follow the platform rules that apply to the channels you use, including the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and Meta's terms for WhatsApp Business, and the acceptable-use rules of our email provider (Amazon SES).
• You must follow the law that applies to you and your messages, including data protection and communications rules in India.
• You must honour opt-outs. Ramflo records STOP replies and unsubscribe requests on a suppression list; you must not try to message those contacts another way.
• You provide us the contact data and the message content. You confirm you may lawfully do so.

Your account

• Keep your sign-in details secure, and tell us promptly if you think they were misused. You are responsible for activity under your account.
• Give accurate information and keep it up to date.
• You are responsible for what is sent from your connected WhatsApp and email accounts, including messages you approve.
• Fees, if any, are as agreed with you in writing.

Suspension and termination

We may pause or limit campaigns, or suspend an account, immediately and without notice if we believe these terms or a provider's rules are being broken, if quality or complaint rates rise, or if needed to protect recipients, other clients or the service. Meta or another provider may also restrict your accounts, and we are not responsible for that.

You may stop using Ramflo and ask us to close your account at any time. After closure we handle your data as described in the Privacy Policy and on the data deletion page.

Liability

• Ramflo is provided on an "as is" and "as available" basis. We do not promise it will be uninterrupted or error-free, or that messages will be delivered or read, since delivery depends on providers such as Meta and email services.
• To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of profit, revenue or data.
• To the extent the law allows, our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose.
• Nothing in these terms limits liability that cannot lawfully be limited.
• You are responsible for claims that arise from your messages, your contact data, or your breach of these terms.

Governing law

These terms are governed by the laws of India. The courts at Chennai have exclusive jurisdiction, subject to any rights that cannot be excluded by law.

Changes to these terms

We may update these terms. We will post the new version here with a new date, and tell clients about significant changes. Continuing to use Ramflo after a change means you accept it.
